Article 4. Non-Protected Works

  1. Copyright protection shall not be afforded to:
    a) expressions of traditional folklore and art;
    b) daily news or information on current facts and events;
    c) official documents: legal acts, treaties and the official translations thereof;
    d) official symbols and signs (flags, coats of arms, medals, coins);;
    e) political speeches, speeches delivered in the court;
    f) results obtained by technical means without the intervention of human creative activity.
  2. Copyright shall not cover scientific discoveries, ideas, principles, methods, procedures, viewpoints, systems, ceremonies, scientific theories, mathematical formulas, statistical diagrams, rules of games, even if they are expressed, described, disclosed, commented in works.

Грамадская ўласнасць Гэты твор не з'яўляецца аб'ектам аўтарскага права паводле з Закона Рэспублікі Беларусь № 262-З ад 17 мая 2011 года "Аб аўтарскім праве і сумежных правах" са змяненнямі і дапаўненнямі № 216-З ад 15 ліпеня 2019 года.

Артыкул 7. Творы, якія не з'яўляюцца аб'ектамі аўтарскага права

  1. Не з'яўляюцца аб'ектамі аўтарскага права:
    • афіцыйныя дакументы (прававыя акты, судовыя пастанаўленні, іншыя дакументы адміністратыўнага і судовага характару, устаноўчыя дакументы арганізацыі), а таксама іх афіцыйныя пераклады;
    • дзяржаўныя сімвалы Рэспублікі Беларусь (Дзяржаўны сцяг Рэспублікі Беларусь, Дзяржаўны герб Рэспублікі Беларусь, Дзяржаўны гімн Рэспублікі Беларусь), сімвалы дзяржаўных узнагарод Рэспублікі Беларусь (ордэны і медалі), дзяржаўныя знакі (грашовыя знакі Рэспублікі Беларусь, паштовыя маркі і іншыя знакі), афіцыйныя геральдычныя сімвалы (сцягі, гербы адміністратыўна-тэрытарыяльных адзінак Рэспублікі Беларусь, геральдычныя знакі, штандары, нагрудныя знакі, эмблемы дзяржаўных органаў і інш.);
    • творы народнай творчасці, аўтары якіх невядомы.
  2. Аўтарскае права не распаўсюджваецца на ўласна ідэі, метады, працэсы, сістэмы, спосабы, канцэпцыі, прынцыпы, адкрыцці, факты, нават калія яны выяўлены, адлюстраваны, растлумачаны і ўвасоблены ў творы.

Каментарый — паводле міждзяржаўных і міжнародных пагадненняў Беларусь з'яўляецца законнай правапераемніцай БССР, таму гэтая ліцэнзія распаўсюджваецца таксама на афіцыйныя дакументы БССР.

Папярэджанне — гэтая ліцэнзія не можа ўжывацца для прапаноў афіцыйных сімвалаў і праектаў афіцыйных дакументаў, якія могуць ахоўвацца аўтарскімі правамі.

Article 8. Works Not Protected by Copyright
The following shall not be protected by copyright:

  1. official documents (laws, court decisions and other texts of a legislative, administrative, judicial or diplomatic nature) together with official translations thereof;
  2. State emblems and official signs (flags, armorial bearings, decorations, monetary signs and other State symbols and official signs);
  3. works of folklore,
  4. communications concerning events and facts that have an informational character.

This work is not an object of copyright according to article 1259 of Book IV of the Civil Code of the Russian Federation No. 230-FZ of December 18, 2006.

Shall not be objects of copyright:

  • official documents of state government agencies and local government agencies of municipal formations, including laws, other legal texts, judicial decisions, other materials of legislative, administrative and judicial character, official documents of international organizations, as well as their official translations;
  • state symbols and signs (flags, emblems, orders, any forms of money, and the like), as well as symbols and signs of municipal formations;
  • works of folk art (folklore), which don't have specific authors;
  • news reports on events and facts, which have a purely informational character (daily news reports, television programs, transportation schedules, and the like).

Warning – This Russian official document, state symbol or sign (postage stamps, coins and banknotes mainly) may incorporate one or more works that can be copyrightable if separated from this document, symbol or sign. In such a case, this work is not an object of copyright if reused in its entirety but, at the same time, extracting specific portions from this work could constitute copyright infringement. For example, the denomination and country name must be preserved on postage stamps.
